1. General Terms

1.1 These Terms and Conditions govern all travel bookings and related services (the “Services”) arranged or facilitated by Truly Luxe (“we,” “us,” or “our”) for the client (“you” or “your”).
1.2 By confirming a booking or making payment on any invoice issued by Truly Luxe, you acknowledge that you have read, understood, and agreed to these Terms.

2. Booking and Confirmation

2.1 All bookings are subject to availability and confirmation.
2.2 A booking is only confirmed upon receipt of a deposit or full payment as specified on your invoice.
2.3 Any special requests (e.g., room upgrades, dietary requirements) are not guaranteed unless confirmed in writing.

3. Payments

3.1 Full payment must be received by the due date indicated on the invoice to secure the booking.
3.2 We accept payment via bank transfer or other agreed-upon methods.
3.3 Late payments may result in cancellation, forfeiture of deposits, or additional charges.
3.4 Invoices issued in foreign currencies must be paid in the currency stated, unless otherwise agreed in writing.

4. Pricing and Inclusions

4.1 All prices are quoted in the agreed currency and are subject to change due to exchange rate fluctuations, taxes, or service provider adjustments.
4.2 Inclusions (e.g., transfers, accommodations, excursions) are outlined in your specific itinerary or invoice. Anything not explicitly stated is excluded.

5. Changes and Cancellations

5.1 By Client:

  • Any request to change or cancel a booking must be made in writing.
  • Charges will apply according to the terms of the relevant supplier(s) and may include forfeiture of deposits or full costs.
  • Truly Luxe reserves the right to charge an administrative fee for processing changes.

5.2 By Truly Luxe or Supplier:

  • We reserve the right to make necessary changes or substitutions in travel arrangements in the event of unforeseen circumstances.
  • In the rare event of cancellation by us or a supplier, you will be offered alternative arrangements or a refund, less any non-refundable expenses already incurred.

6. Client Responsibilities

6.1 You are responsible for ensuring that all personal details provided are accurate and that all passengers meet visa, passport, vaccination, insurance, and travel requirements.
6.2 Truly Luxe is not liable for any issues resulting from incomplete or incorrect documentation.

7. Liability

7.1 Truly Luxe acts as an intermediary between you and third-party suppliers. While we vet all providers, we are not liable for the actions, omissions, or failures of third-party providers.
7.2 We do not accept liability for any loss, injury, delay, or inconvenience resulting from force majeure, travel restrictions, governmental actions, natural disasters, pandemics, or other events beyond our control.

8. Insurance

8.1 Travel insurance is strongly recommended and remains your responsibility to arrange.
8.2 Truly Luxe will not be held liable for any costs incurred due to lack of adequate insurance coverage.

9. Confidentiality

9.1 All client information, including travel preferences and arrangements, is handled with strict confidentiality and discretion, in line with our privacy policy.

10. Governing Law and Jurisdiction

10.1 These Terms shall be governed by and construed in accordance with the laws of South Africa.
10.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

11. Amendments

11.1 Truly Luxe reserves the right to amend these Terms at any time. The applicable version will be the one in force at the time of booking.

12. Force Majeure

12.1 Truly Luxe does not accept liability or pay you compensation where the performance of our contractual obligations is affected by “force majeure” (included but not limited to war, threat of war, riot, civil or political unrest, industrial dispute, terrorist activity, natural or nuclear disasters, fire, adverse weather conditions, closure of ports or airports, air traffic control delays, technical problems, circumstances amounting to “force majeure”. Truly Luxe will always use its best endeavors to assist passengers where necessary and or possible.
